제1조(목적)

제1조(목적) 이 조례는 전북특별자치도 출생 미등록 이주 아동에 대한 인도적 지원과 기본권 보장을 통해 모든 아동이 인간으로서의 존엄성을 인정받고 차별 없이 보호와 지원을 받을 수 있도록 제도적 기반을 마련함을 목적으로 한다.

제2조(정의) 이 조례에서 사용하는 용어의 뜻은 다음과 같다.1. “출생 미등록 이주 아동”이란 출생 등록이 되어 있지 아니하고 전북특별자치도에 주소 또는 거소를 둔 18세 미만인 사람을 말한다.2. “전북특별자치도 출생 미등록 이주 아동 지원 대상 확인서”란 전북특별자치도가 출생 미등록 이주 아동 보호 및 지원을 위하여 필요한 인적사항을 기재하여 발급하는 문서를 말한다.3. “전북특별자치도 출생 미등록 이주 아동 확인증”이란 전북특별자치도 출생 미등록 이주 아동 지원 대상 확인서를 발급받은 아동이 이 조례에 따른 지원을 받을 때 본인 확인을 위하여 제시할 수 있도록 발급하는 개인 확인증을 말한다.4. “출생 미등록 이주 아동 공적확인”이란 출생 사실을 증명할 수 있는 공적인 자료나 절차를 통해 해당 아동의 출생을 확인하는 것을 말한다.

제3조(도지사의 책무)

제3조(도지사의 책무) 전북특별자치도지사(이하 “도지사”라 한다)는 출생 미등록 이주 아동 공적확인(이하 “공적확인”이라 한다) 및 출생 미등록 이주 아동의 보호ㆍ지원을 위한 제도와 시책을 추진해야 한다.

제4조(공적확인 신청자)

제4조(공적확인 신청자)① 공적확인 신청은 아동의 부 또는 모가 할 수 있다.② 이주 아동의 출생 미등록 사실을 인지한 누구나 도지사에게 출생 공적확인을 요청할 수 있다.

제5조(신청 방법 등)

제5조(신청 방법 등)① 공적확인을 신청할 경우 별지 제1호서식 신청서와 다음 각 호의 사항을 확인할 수 있는 서류를 제출해야 한다.1. 아동의 성명ㆍ성별 및 주소ㆍ거소2. 아동의 출생 연월일3. 부모 양쪽 또는 한쪽의 성명ㆍ출생 연월일(확인이 가능한 경우에 한한다)ㆍ국적(국적이 있는 경우에 한한다)② 도지사는 제1항에 따라 신청사항의 확인을 위해 필요한 경우 사실조사를 할 수 있다. 다만, 제3자의 요청으로 신청서가 접수되었을 경우에는 반드시 현장 방문 및 사실관계를 조사하고 확인하여야 한다.

제6조(확인서 등 발급)

제6조(확인서 등 발급)① 도지사는 신청일로부터 14일 이내에 별지 제2호서식의 전북특별자치도 출생 미등록 이주 아동 지원 대상 확인서(이하 “확인서”라 한다) 및 별지 제3호서식 전북특별자치도 출생 미등록 이주 아동 확인증(이하 “확인증”이라 한다)을 발급해야 한다. 다만, 특별한 사유가 있는 경우에는 그 내용을 신청인에게 통지하고 발급기한을 연장할 수 있다.② 사실조사 후 확인서 발급 신청사항과 다를 경우 도지사는 그 결과를 신청인에게 통지하고 확인증을 발급하지 아니할 수 있다.③ 확인증을 발급받더라도 대한민국 국적이나 체류자격을 취득한 것으로 추정하지 아니하며, 이주 아동의 출생등록과 그 아동의 국적 취득 및 체류자격의 부여는 별개의 사항으로 한다.

제7조(지원)

제7조(지원) 도지사는 확인증을 발급받은 출생 미등록 이주 아동이 기본권을 보장받을 수 있도록 행정적 지원을 할 수 있다.1. 보건ㆍ의료 서비스 이용2. 긴급 복지 및 생계 지원3. 어린이집, 유치원 등의 보육 서비스 또는 보육료 지원4. 한국어 학습 등 기초적인 사회ㆍ문화 적응 지원

제8조(사후관리)

제8조(사후관리)① 도지사는 출생 미등록 이주 아동의 지원과 확인증 관리를 위하여 필요한 경우 지원 대상자를 확인할 수 있다.② 출생 미등록 이주 아동 또는 보호자는 발급내용에 변동이 있는 경우 도지사에게 통보하여 재발급을 신청할 수 있다.③ 재발급을 신청하고자 하는 자는 별지 제1호서식 신청서를 제출하고, 기존의 확인서 및 확인증을 반납하여야 한다. 다만, 분실로 인한 재신청의 경우 반납하지 않을 수 있다.

제9조(협력체계 구축)

제9조(협력체계 구축) 도지사는 출생 미등록 이주 아동의 보호 및 지원을 할 수 있도록 행정기관, 의료ㆍ보육ㆍ교육 시설, 아동복지시설 및 아동복지단체 등 관계기관과 협력체계를 구축할 수 있다.

제10조(홍보 및 포상)

제10조(홍보 및 포상)① 도지사는 출생 미등록 이주 아동 보호와 인식개선을 위한 교육과 홍보를 추진할 수 있다.② 도지사는 출생 미등록 이주 아동 보호에 기여한 주민, 단체 등에게 「전북특별자치도 포상 조례」에 따라 포상할 수 있다.
