제1조(목적) 이 조례는 경기도 출생 미등록 외국인 아동을 적극 발굴하여 모든 아동이 태어난 순간부터 인간으로서의 존엄성을 인정받고 보호받으며, 최소한의 복지·의료·보건·교육 등의 공적 서비스를 받을 수 있도록 출생 미등록 외국인 아동 공적확인 및 지원체계를 마련하는 것을 목적으로 한다.

제2조(기본이념)

제2조(기본이념) 경기도 모든 아동은 출생 시부터 출생 등록 여부와 자신 또는 부모의 국적, 체류자격, 성별, 연령, 종교, 사회적 신분, 재산, 장애 유무, 출생지역, 인종 등에 따른 어떠한 종류의 차별 없이 보호와 지원받을 권리를 가진다.

제3조(정의)

제3조(정의) 이 조례에서 사용하는 용어의 정의는 다음과 같다.1. “출생 미등록 외국인 아동”이란 국내 출생하였으나, 출생 확인이 되지 않고 경기도에 주소 또는 거소를 둔 18세 미만인 외국인을 말한다.2. “경기도 출생 미등록 외국인 아동 지원대상 확인서”란 경기도가 출생 미등록 외국인 아동 보호 및 지원을 위해 해당 아동의 성명 및 생년월일 등 신상정보를 기록하여 발급하는 증서를 말한다.3. “경기도 출생 미등록 외국인 아동 확인증”이란 경기도 출생 미등록 외국인 아동 지원대상 확인서를 발급받은 아동이 소지하고 연계 서비스 이용 시 제시할 수 있도록 발급하는 개인 확인용 카드를 말한다.4. “출생 미등록 외국인 아동 공적확인”이란 출생 사실을 증명할 수 있는 공적인 자료나 절차를 통해 해당 아동의 출생을 확인하는 것을 말한다.

제4조(도지사의 책무)

제4조(도지사의 책무) 경기도지사(이하 “도지사”라 한다)는 출생 미등록 외국인 아동이 발생하지 않도록 적극적으로 이들을 발굴하고, 출생 미등록 외국인 아동 공적확인 및 지원을 위한 제도와 시책을 추진해야 한다.

제5조(신청 주체 및 자격)

제5조(신청 주체 및 자격)① 출생 미등록 외국인 아동 공적확인 신청은 아동의 부 또는 모가 할 수 있다.② 부 또는 모가 출생신고 또는 출생 미등록 외국인 아동 공적확인 신청을 하지 아니할 경우 도지사가 출생 미등록 외국인 아동 공적확인으로 확인할 수 있다.③ 외국인 아동의 출생 미등록 사실을 인지한 누구나 도지사에게 출생 미등록 외국인 아동 공적확인을 요청할 수 있다.

제6조(신청 방법 등)

제6조(신청 방법 등)① 부 또는 모가 출생 미등록 외국인 아동 공적확인을 신청할 경우 다음 각 호의 사항을 기재한 별지 제1호 서식 신청서와 아래 각 호의 사항을 확인할 수 있는 서류를 제출해야 한다.1. 아동의 성명·성별 및 주소 또는 거소2. 아동의 출생연월일3. 부모 양쪽 또는 한쪽의 성명·출생연월일(확인이 가능한 경우에 한한다)·국적(국적이 있는 경우에 한한다)② 도지사는 제1항에 따라 신청사항의 확인을 위해 필요한 경우 사실조사를 할 수 있다. 다만 제3자의 요청으로 신청서가 접수되었을 경우에는 반드시 현장 방문 및 사실관계를 조사하고 확인하여야 한다.

제7조(확인서 등 발급)

제7조(확인서 등 발급)① 도지사는 신청일로부터 14일 이내에 별지 제2호서식 경기도 출생 미등록 외국인 아동 지원대상 확인서(이하 “확인서”라 한다) 및 별지 제3호 서식 경기도 출생 미등록 외국인 아동 확인증(이하 “확인증”이라 한다)을 발급해야 한다. 다만, 특별한 사유가 있는 경우에는 그 내용을 신청인에게 통지하고 발급기한을 연장할 수 있다.② 사실조사 후 확인서 발급 신청사항과 다를 경우 도지사는 그 결과를 신청인에게 통지하고 확인증을 발급하지 아니할 수 있다.③ 확인증을 발급받더라도 대한민국 국적이나 체류자격을 취득한 것으로 추정하지 아니하며, 외국인아동의 출생등록과 그 아동의 국적 취득 및 체류자격의 부여는 별개의 사항으로 한다.

제8조(비밀보호 의무)

제8조(비밀보호 의무)① 업무를 수행하거나 수행하였던 공무원 및 위탁받은 자는 그 직무상 알게 된 개인정보 및 민감한 정보에 대하여 정당한 사유 없이 공개하여서는 아니 된다.② 도지사는 정보보호 및 개인정보보호와 관련된 법령 및 규정에 따라 공무원 및 위탁받은 자에게 정기적인 보안교육을 실시할 수 있다.

제9조(지원)

제9조(지원)① 도지사는 확인증을 발급받은 출생 미등록 외국인 아동이 기본권을 보장받을 수 있도록 인도적으로 필요한 범위 내 공적서비스 이용에 관하여 다음 각 호의 행정적 지원 및 연계를 할 수 있다.1. 보건·의료 서비스 이용2. 긴급 복지 및 생계 지원3. 어린이집, 유치원 등의 보육 서비스 또는 보육료 지원4. 한국어 학습 등 기초적인 사회·문화 적응 지원

제10조(사후관리)

제10조(사후관리)① 도지사는 출생 미등록 외국인 아동의 지원과 확인증 관리를 위하여 필요한 경우 지원대상자를 확인할 수 있다.② 출생 미등록 외국인 아동 또는 보호자는 발급내용에 변동이 있는 경우 도지사에게 통보하여 재발급을 신청할 수 있다.③ 재발급을 신청하고자 하는 자는 별지 제1호 서식 신청서를 제출하고, 기존의 확인서 및 확인증을 반납하여야 한다. 다만, 분실로 인한 재신청의 경우 반납하지 않을 수 있다.

제11조(협력체계 구축)

제11조(협력체계 구축) 도지사는 적절한 보호조치를 제공할 수 있도록 행정기관, 의료·보육·교육 시설, 아동복지시설 및 아동복지단체 등 관계기관과 상시적인 협력체계를 구축해야 한다.

제12조(홍보 및 포상)

제12조(홍보 및 포상)① 도지사는 출생 미등록 외국인 아동 발굴 활성화와 인식개선을 위한 교육과 홍보를 추진하여야 한다.② 도지사는 출생 미등록 외국인 아동 발굴 및 보호에 기여한 주민, 단체 등에게 「경기도 포상 조례」에 따라 포상할 수 있다.

제13조(사무의 위탁)

제13조(사무의 위탁)① 도지사는 이 조례에서 정하는 도지사의 권한에 속하는 사무의 일부를 관련 단체 등에 위탁할 수 있다.② 제1항에 따른 위탁에 필요한 사항은 「경기도 사무의 공공기관 위탁ㆍ대행 조례」 및 「경기도 사무의 민간위탁 조례」에 따른다.
